Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Calzy mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Mitologic Sp. z o.o. (NIP: 5833537382), a company registered in Poland, operating as Calzy ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of those changes.

2. Description of Service

Calzy is an AI-powered calorie and nutrition tracking application that helps users monitor their dietary intake and work toward their health goals. The App provides:

• AI-powered photo analysis to estimate nutritional content of meals
• Manual food logging with detailed nutritional information
• Barcode scanning for packaged foods
• Weight tracking and progress monitoring
• Personalized calorie and macronutrient goals
• Integration with Apple HealthKit
• Progress photo storage
• Cloud sync across devices

3. Account Registration

To use certain features of the App, you must create an account using Sign in with Apple or Google Sign-In. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access to your account

You may only create one account per person. We reserve the right to suspend or terminate accounts that we believe violate these Terms.

4. Subscription Terms

4.1 Free and Premium Features

Calzy offers both free and premium subscription tiers. Certain features are only available to premium subscribers ("Calzy Pro"). The specific features available in each tier may change over time.

4.2 Subscription Options

Premium subscriptions are available in the following billing periods:

• Weekly subscription
• Monthly subscription
• Yearly subscription

4.3 Payment and Billing

Subscriptions are processed through the Apple App Store. By purchasing a subscription, you agree to Apple's payment terms. Payment will be charged to your Apple ID account at confirmation of purchase.

4.4 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

4.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

4.6 Refunds

Refund requests are handled by Apple according to their refund policy. We do not directly process refunds. To request a refund, visit reportaproblem.apple.com.

4.7 Free Trials

We may offer free trial periods for premium subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription at the standard rate.

4.8 Promotional Offers

We may occasionally offer promotional pricing or rewards (such as through our referral program). These offers are subject to specific terms and may be modified or discontinued at any time.

5. User Responsibilities

By using Calzy, you agree to:

• Provide accurate information when logging food and health data
• Use the App only for lawful purposes
• Not share your account credentials with others
• Not attempt to circumvent any security features of the App
• Not use the App to harass, abuse, or harm others
• Not upload content that is illegal, offensive, or violates third-party rights
• Not use automated systems or bots to access the App

6. AI Analysis Disclaimer

IMPORTANT: THE AI-POWERED NUTRITIONAL ANALYSIS FEATURE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED ACCURATE OR RELIED UPON FOR MEDICAL OR DIETARY DECISIONS.

You acknowledge and agree that:

• AI analysis of meal photos provides estimates only and may be inaccurate
• Nutritional values can vary significantly based on portion sizes, ingredients, and preparation methods
• The App cannot identify all ingredients, allergens, or dietary restrictions from photos
• You should verify nutritional information from authoritative sources when accuracy is critical
• We are not responsible for any health consequences resulting from reliance on AI estimates

7. Health Disclaimer

CALZY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

You acknowledge and agree that:

• The App is intended for general wellness and informational purposes only
• Calorie and nutritional recommendations are general guidelines, not personalized medical advice
• You should consult with healthcare professionals before making significant dietary changes
• The App is not intended to diagnose, treat, cure, or prevent any disease or health condition
• If you have any medical conditions, eating disorders, or health concerns, consult a doctor before using the App
• We are not liable for any health outcomes resulting from your use of the App

8. Intellectual Property

8.1 Our Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Calzy and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8.2 Your Content

You retain ownership of any content you create or upload to the App, including food photos and notes. By using the App, you grant us a limited, non-exclusive license to use, store, and process your content solely to provide and improve the service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide about the App may be used by us without any obligation to you.

9. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for any fraudulent or illegal purpose
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App or its servers
• Scrape, collect, or harvest user data
• Use the App to send spam or unsolicited messages
• Impersonate any person or entity
• Violate any applicable laws or regulations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALZY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content
• Loss of profits or revenue
• Personal injury or health consequences
• Errors or inaccuracies in nutritional information
• Interruption of service
• Unauthorized access to your data

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The results of using the App will meet your requirements
• Nutritional information will be accurate

12. Indemnification

You agree to indemnify, defend, and hold harmless Calzy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the App

13. Termination

13.1 Termination by You

You may stop using the App at any time. To delete your account and all associated data, go to Settings within the App and select "Delete Account."

13.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App will immediately cease.

13.3 Effect of Termination

Upon termination, all licenses granted to you will terminate, and you must cease all use of the App. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property, disclaimer of warranties, limitation of liability, and indemnification.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland and the European Union, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Poland.

15. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve any dispute informally by contacting us at support@calzy-app.com. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved, either party may proceed with formal legal action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calzy regarding your use of the App and supersede any prior agreements.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
